Managing Change
Overview
A great many factors can contribute to the need for organisational change, including: technological advances, competitive pressures, new legislation, and altered strategic priorities. Research indicates that organisations go through major changes approximately once every three years, with smaller changes happening almost continuously.
With this in mind, there is an essential need for management to be up-to-speed with the legal requirements imposed in certain change situations. There is also a need for the practical aspects to be weighed in the balance so that employees’ voices are heard at an early stage and any concerns can be addressed. Doing so will help to ensure a smoother transition in the long-run.
This session will help delegates to get to grips with the requirements of the Information and Consultation Regulations, TUPE Regulations, and the redundancy provisions.
Learning Outcomes
By the end of this session, delegates will have the knowledge to enable them to:
· understand the operation of the Information and Consultation of Employees Regulations (ICE Regs);
· implement a strategy to deal with the ICE Regs;
· understand the pros and cons of pre-existing agreements, negotiated agreements, and the standard provisions in the Regs themselves;
· understand when a redundancy situation exists;
· feel confident about handling both collective and individual redundancy consultations;
· carry out a redundancy selection exercise;
· calculate redundancy payments;
· identify circumstances where the Transfer of Undertakings (Protection of Employment) Regulations (TUPE Regs) might apply;
· understand who transfers along with what terms and conditions;
· comply with the employee liability information provisions of the TUPE Regs; and
· understand how the Regs apply to insolvent businesses.
Who is it for?
The course is suitable for all those with responsibility for:
· implementing workforce changes, e.g. HR professionals, line mangers, and senior managers;
· reviewing and updating change management policies and practices;
· training individuals to carry out change management exercises.
The course is designed to appeal to organisations of all sizes, whether in the private or public sectors but is most likely to appeal to larger organisations.
Approach and Duration
The course will cover both legal issues and practical tips and will be delivered by Alan Sutherland, a senior solicitor with Maclay Murray & Spens LLP.
Comprising two interactive sessions of approximately 45 minutes, and two break-out sessions, the course will run from 9.30am – 12.30pm. The break-out sessions will involve consideration of a redundancy case study designed to put the knowledge gained during the morning to practical use, reinforcing learning.
Who will deliver the course?
The course will be delivered by Alan Sutherland, a senior solicitor specialising in employment law at Maclay Murray & Spens LLP. Alan advises on all aspects of employment law and is particularly interested in unfair dismissal, advising on redundancies and business reorganisations, contractual matters and working time issues, along with the negotiation of service agreements, contracts of employment and severance packages. Alan also has experience of advising on UK employment law aspects within foreign jurisdictions, as well as appearing on behalf of employers and employees in a variety of matters in the Employment Tribunal.
