Recruitment and the Law
Overview
The success of any organisation is reliant on having the right people in the right positions. With this in mind, effective recruitment practices are essential.
A recent CIPD survey estimated the average cost of filling a vacancy per employee at £3,950, rising to £4,625 if the associated costs of labour turnover were taken into account. The same survey indicated that 85% of organisations were reporting recruitment difficulties, which included a lack of specialist skills and required experience. Hiring and retaining the right people in the present recruitment climate is therefore essential.
It is well worth investing time and energy at the recruitment stage as it is likely to take far longer to “manage out” a new employee who soon demonstrates that they have not lived up to all their application form or interview suggested. You will also want to avoid being dragged into legal action which could prove costly not only in financial terms, but to your reputation as an employer of choice.
This session will help delegates to avoid both the practical and legal pitfalls which might arise at each stage of a recruitment exercise.
Learning Outcomes
By the end of this session, delegates will have the knowledge to enable them to:
· understand the equal opportunities issues which arise at this stage of the employment relationship;
· prepare job specs, person specs and job adverts;
· short-list candidates fairly;
· plan and carry out the interview process;
· decide whether additional checks are necessary;
· make the job offer;
· manage the recruitment of fixed-term workers and agency workers.
Who is it for?
The course is suitable for all those with responsibility for:
· recruiting new members of staff, e.g. HR professionals, line mangers, and senior managers;
· reviewing and updating recruitment policies and practices;
· training individuals to carry out recruitment exercises.
The course is designed to appeal to organisations of all sizes, whether in the private or public sectors.
Approach and Duration
The course will cover both legal issues and practical tips and will be delivered by Chris Phillips, a Partner of Maclay Murray & Spens LLP.
Comprising two interactive sessions of approximately 45 minutes, and two break-out sessions, the course will run from 9.30am – 12.30pm. The first break-out session will involve review of a job application and equal opportunities monitoring form, while the second will involve consideration of at least one case study designed to put the knowledge gained during the morning to practical use, reinforcing learning.
Who will deliver the course?
The course wll be delivered by Chris Phillips, a partner specialising in employment law at Maclay Murray & Spens LLP. He acts for a broad range of clients in the private and public sector and for institutions and individuals. He makes regular appearances before the Employment Tribunal and Employment Appeal Tribunal, across the UK. His particular areas of interest include discrimination, business re-organisations and industrial relations. He is a panel solicitor for the Joint Equalities Commissions and a member of both the Employment Lawyers Association and the Scottish Discrimination Lawyers Association. He is accredited by the Law Society of Scotland as a specialist in Employment Law.
